Agreement and scope

These Terms of Use apply when you create an account or use Totopo's app, website, and related services. By using Totopo, you agree to these terms and the Privacy Policy. If you do not agree, do not use Totopo.

Using Totopo and your account

Totopo is a food journal and nutrition tracking app. You are responsible for the information you enter, the goals you choose, and how you use the estimates the app provides. Provide accurate account information, keep access to your account secure, and notify us if you believe someone has used it without permission.

Features, limits, availability, pricing, and design may change as Totopo improves. Some changes may require you to install an app update.

Age eligibility

You must be at least 13 years old to use Totopo. If you are under the age of legal majority where you live, you may use Totopo only with permission from a parent or legal guardian.

Nutrition, AI, and health estimates

Totopo is a general wellness food journal. Nutrition and goal outputs are estimates for informational use and may be incomplete, inaccurate, or based on assumptions. Automated nutrition estimates, search results, and AI responses can also be wrong. Review them before relying on them, especially for allergies, medical conditions, or clinical nutrition needs.

Totopo is not medical advice and should not be used to diagnose, treat, prevent, or manage a disease or medical condition. It is not an emergency service. Seek appropriate emergency or professional care instead of relying on Totopo for an urgent concern, and talk to a qualified health professional before making medical or diet decisions that could affect your health.

Your content

You keep ownership of the journal entries, photos, scans, corrections, profile details, chat messages, and other content you add. You give Totopo a limited, non-exclusive permission to host, copy, transmit, transform, and process that content only as technically necessary to provide, secure, maintain, and support the services you use. This permission does not transfer ownership of your content.

Do not upload content you do not have the right to use, and do not add sensitive information that is not needed for food logging.

Subscriptions

Totopo may offer auto-renewing subscriptions for paid features. Subscription name, duration, price, trial terms if any, renewal behavior, and included features are shown before purchase and may vary by country, currency, tax, or App Store rules.

Subscriptions automatically renew unless canceled through your App Store account before renewal. Deleting the app or deleting your Totopo account does not cancel an active App Store subscription. Refunds, cancellations, and billing issues are handled by Apple and the App Store according to their rules.

Service providers and data processing

Totopo uses categories of service providers to operate the app, including account authentication, cloud hosting and sync, subscriptions, barcode lookup, AI processing, search, analytics, security, and support. These providers may process information only as needed to deliver their services for Totopo, as described in the Privacy Policy.

When you use an AI-powered feature, Totopo may send the text, images, journal context, profile information, goals, conversation context, or optional Apple Health activity reasonably needed to complete your request. By using Totopo, you agree to this processing as described in the Privacy Policy.

Acceptable use

• Do not misuse the app or interfere with its systems.
• Do not try to bypass subscription checks, rate limits, or access controls.
• Do not use the app to upload unlawful, harmful, or infringing content.
• Do not reverse engineer the app except where the law allows it.

Totopo intellectual property

Totopo's software, branding, interface, and original content are protected by applicable intellectual property laws. Except where the law permits it, these terms do not give you permission to copy, distribute, sell, or create derivative works from Totopo's protected materials.

Third-party services

Totopo relies on third-party services for functions such as sign-in, cloud storage and sync, subscriptions, barcode lookup, external AI processing, and search. Those services may have their own terms. Totopo is not responsible for third-party services that you access independently, but the Privacy Policy explains how providers process information for Totopo.

Suspension and termination

You may stop using Totopo or delete your account at any time. We may suspend or terminate access when reasonably necessary to protect users or the service, comply with law, investigate abuse, or address a serious or repeated violation of these terms. Provisions that by their nature should survive termination remain effective, including ownership, disclaimers, and limitations of liability.

Account deletion

You can delete your account from app settings. This removes your Totopo account and associated app data, subject to limited information retained when needed for legal, billing, security, fraud-prevention, dispute-resolution, support, or backup purposes. Account deletion does not cancel an active App Store subscription.

Availability and disclaimers

Totopo is provided as is and as available. We do not promise that the app will be uninterrupted, error-free, or that nutrition estimates will always be correct.

Limitation of liability

To the fullest extent permitted by applicable law, Totopo is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or use arising from your use of the app. Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

Changes to these terms

We may update these terms as Totopo changes. We will post the updated terms here, change the last-updated date, and provide any additional notice required by applicable law for material changes. Continuing to use Totopo after updated terms take effect means you accept them.

Severability and entire agreement

If a provision of these terms cannot be enforced, the remaining provisions remain effective to the extent allowed by law. These terms and the Privacy Policy form the agreement between you and Totopo concerning the services covered here and replace prior understandings about those services.
